Terms of Service
Last updated October 29, 2026
The short version: ClubVIP is a marketplace. Venues sell memberships, tables, bottle service and other perks through it. Members buy them and show a QR pass at the door. ClubVIP runs the apps, processes the payments through Stripe and keeps a platform fee. The venue is responsible for what it sells and for honoring it. The full terms follow.
1. Who these terms cover
These Terms of Service ("Terms") are an agreement between you and ClubVIP ("ClubVIP", "we", "us") and apply to the ClubVIP website, the member app, the venue portal, the door scanner and the services behind them (together, the "Service"). They cover two kinds of users:
- Venues: bars, clubs, lounges and other businesses that list memberships, add-ons and events for sale.
- Members: people who join a venue's program, buy add-ons or hold a pass.
By creating an account, listing a venue, buying a membership or using a pass you accept these Terms. If you are using the Service for a business, you confirm that you have authority to bind that business.
2. ClubVIP is a marketplace
ClubVIP provides the storefront, the payment flow, the passes and the door verification. The venue, not ClubVIP, is the seller of every membership, table, bottle, ticket or other perk ("Items"). The venue decides what it offers, at what price, with what rules, and the venue is responsible for delivering it. ClubVIP does not own, operate or control any venue and does not guarantee entry, service, availability or the quality of any Item.
3. Accounts
Members sign in with a mobile phone number and a one-time code sent by text message (see the Text Message Terms). Venues sign in through the venue portal and may create staff logins for the door. You are responsible for everything done through your account and for keeping your phone and sign-in codes to yourself. Tell us promptly through the contact form if you believe your account has been used without your permission.
You must be at least 18 years old to hold a ClubVIP account, and you must meet the venue's own age and admission rules, which may be stricter. A pass does not override a venue's right to refuse entry under its policies or the law.
4. Memberships, add-ons and passes
- A membership gives you the benefits the venue has published for that tier for as long as it is active. Benefits can change; the venue will show the current ones in the app.
- Recurring memberships renew automatically at the interval shown when you joined, until you cancel. Cancelling stops future renewals and leaves the current period active to its end.
- Add-ons such as tables, bottle service and skip-the-line passes are for the date, time and venue stated when you bought them.
- Your pass is personal. It is tied to your account and shows your name, tier and, if you added one, your photo. The code on it changes every 30 seconds and cannot be shared by screenshot. Letting someone else use your pass, or presenting a pass that is not yours, is grounds for the venue or ClubVIP to revoke your memberships without refund.
- Guest allowances, where a venue offers them, are for guests who arrive with the member and are admitted at the venue's discretion.
5. Payments, fees and refunds
Payments are processed by Stripe. By paying through the Service you also agree to Stripe's terms. ClubVIP does not store your full card number.
Members pay the price the venue has set. ClubVIP charges members nothing on top of that price.
Venues pay ClubVIP a platform fee on each membership and add-on sale, currently 10% plus 50¢ per transaction, which includes card processing. ClubVIP deducts its fee and pays the remainder to the venue on the payout schedule the venue selects. Venues are responsible for their own taxes on what they sell.
Refunds are decided by the venue, which is the seller. If a venue cannot honor an Item you paid for, ask the venue first. If you cannot reach a resolution, contact us and we will help. ClubVIP may issue a refund on a venue's behalf, and recover it from the venue, where we determine an Item was not delivered. Chargebacks filed with your card issuer for Items that were delivered may lead to suspension of your account.
6. Venue obligations
If you list a venue you agree to:
- Hold the licences and permissions needed to operate and to sell what you list, including alcohol licences where relevant.
- Describe Items accurately and honor every active membership and paid add-on on the terms you published.
- Admit members according to your published tiers, subject to capacity, the law and your ordinary house rules, applied without unlawful discrimination.
- Use member information only to run your membership program, and keep it secure. See the Privacy Policy for what you receive.
- Keep your payout details, business details and staff logins current, and remove staff access when someone leaves.
- Not use the Service to sell anything illegal, to resell access you do not control, or to collect payments unrelated to your venue.
ClubVIP activates new venues after a short review and may decline, pause or remove a venue that breaks these Terms, generates repeated unresolved complaints or presents a fraud or legal risk.
7. Acceptable use
You agree not to: copy, forward or forge passes; probe, overload or attempt to bypass the door verification or any other part of the Service; scrape the Service; use it to send unsolicited messages; misrepresent who you are; or interfere with other users. We may suspend or close accounts that do.
8. Content
Venues own the names, logos, photos, descriptions and posts they upload and give ClubVIP a licence to display them in the Service, in passes and in venue pages for as long as the venue is listed. Venues confirm they have the right to use everything they upload. ClubVIP owns the Service itself, including its software, design and the ClubVIP name and mark.
9. Availability
We work to keep the Service available and the door scanner working even when a venue's internet does not. The Service is nonetheless provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free, and a venue remains responsible for admitting its members if the scanner is unavailable.
10. Limitation of liability
To the fullest extent permitted by law, ClubVIP is not liable for indirect, incidental, special or consequential losses, or for lost profits, arising from the Service or from any venue or Item. ClubVIP's total liability to you for any claim relating to the Service is limited to the greater of the platform fees ClubVIP earned from your transactions in the twelve months before the claim or US $100. Nothing in these Terms limits liability that cannot be limited by law.
11. Ending your account
Members may close their account at any time from the app; active memberships then run to the end of their paid period and do not renew. Venues may delist at any time by contacting us; existing paid memberships must be honored to the end of their period or refunded. We may suspend or close accounts as described above, and will tell you why unless the law prevents it.
12. Changes to these Terms
We may update these Terms as the Service changes. When we make a material change we will show a notice in the app or email the address on your account at least 14 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
13. Disputes
Please contact us first. Most problems can be fixed by a person in a day. Any dispute that cannot be resolved that way will be handled in the courts where ClubVIP is established, under the law of that place, unless the law where you live gives you rights that cannot be taken away.
